These Conditions of Sale apply to purchases made on the site https://www.materiaceramica.com managed by l’Alveare di Maria Antonietta Taticchi with registered office in Via dei Priori n 70 – 06123 Perugia (Pg), Italy – C.F. TTCMNT60H70G478O and VAT number 00765740543 – REA PG – 146090.
These Conditions of Sale and the related documentation comply with the applicable provisions of Legislative Decree 206/2005 (“Consumer Code”).
These Conditions of Sale apply to all orders and all purchases made on the materiaceramica.com website. Any changes or new conditions of sale will be applied only to sales concluded after their publication.
Before placing an order for products, Buyers will be given the opportunity to review them and will be asked to accept them.
The sending of the order by the Buyer constitutes acceptance of the Conditions of Sale at that time.
How to purchase
Purchasing on the materiaceramica.com website is easy and simple:
- Select the desired products and add them to the shopping cart by clicking on the order button;
- go to the checkout for payment by clicking on the proceed with the order in the cart button;
- enter your details, shipping address, payment method and confirm the order;
- if it is a gift, specify the recipient’s shipping address.
In order to place an order, the Buyer can create a “Customer Account” (username and password). The Buyer is required to maintain the confidentiality of his password and assumes responsibility for every action performed and every purchase made through his account. Alternatively, the Buyer can place the order in “Guest” mode, without creating or accessing a Customer Account.
Art. 1 Object of the contract
L’ALVEARE by Maria Antonietta Taticchi at Via dei Priori n. 70, sells and the Buyer purchases through the internet, with a remote sales contract, ceramic products, selected and ordered among those included in the electronic catalogue, which will be produced specifically for the Buyer.
Once the order has been placed, L’ALVEARE will confirm to the Buyer in real time the registration of the purchase order via a message sent to the email address indicated by the Buyer during the purchase procedure.
L’ALVEARE di Maria Antonietta Taticchi reserves the right not to accept incomplete purchase orders, not duly completed, transmitted with false and/or invented data.
Art. 2 – Buyer’s obligations
The Buyer undertakes, once the online purchase procedure has been completed, to print and/or keep these general conditions, which, moreover, he/she will have already viewed and accepted as an obligatory step in the purchase, as well as to printing of the specifications of the product being purchased. This is in order to fully satisfy the condition referred to in articles 52 and 53 of Legislative Decree 206/05. 206/05.
The Buyer is strictly prohibited from entering false and/or invented data in the registration procedure necessary to activate the process for the execution of this sales agreement and the related further communications. The personal data and e-mail must also correspond exclusively to your personal data and not to those of third parties.
The Buyer declares to be an adult (+18).
Art. 3 – Product Characteristics
The products on sale on the website www.materiaceramica.com are unique pieces handmade by the master craftsman Maria Antonietta Taticchi and her daughter Caterina Aquinardi specifically for the Buyer who orders them. It is for this reason that each product sold may have slight variations in shape, colour, decoration and measurements compared to what is presented in the item description; Since these are artistic craftsmanship products, any small imperfections represent elements of quality and originality and not defects.
Due to the nature of the products on sale specified in the previous point 1, L’ALVEARE will not be able to reimburse the customer for “object not conforming to the description” if slight differences in aesthetics and dimensions compared to the photo and description of the presentation sheet are contested of the product purchased.
The production of the ceramic items presented in the online catalog requires on average 15 – 30 working days.
The times indicated are valid for supplies of max 2 pieces and for objects already in stock such as terracotta (unglazed, undecorated object and not subjected to a second cooking at 970°)
For larger quantities or for objects to be created, L’ALVEARE will communicate the necessary production times to the Buyer.
The Buyer is given the right to request the personalization of the object. The exercise of this right makes the Product Personalized and, based on Legislative Decree 185/99, the Buyer will not be able to exercise the Right of Withdrawal on it.
Art. 4 – Shipments
Shipments and deliveries are made via courier; shipping costs, unless otherwise indicated, are the responsibility of the Buyer and are included in the invoice issued at the time of shipment. The courier’s delivery times in Italy are 2/7 working days, depending on the destination of the goods, to which must be added the times necessary for the production of the ordered items indicated in the Art. 3. 3. at point 3.
The goods (products) travel at the Buyer’s risk, any damage must be notified to the carrier as the sole person responsible. The Buyer is required to check the goods upon delivery, indicating, in case of damage, “reservation to inspect damaged goods received” in the Courier’s proof of delivery. No compensation can be made to L’ALVEARE for said damages.
In accordance with the international laws that regulate trade and import-export exchanges, all the goods of L’ALVEARE di Maria Antonietta Taticchi are shipped from – Perugia (Italy) with an invoice showing the amount (in Euros) paid and the contents of the package. The products sold may be subject to the payment of import taxes which are the sole responsibility of the final Purchaser.
Art. 5 – Transport damage
In the event that the Buyer finds any external damage to the packaging or the mismatch in the number of packages, he/she must immediately place a written control reservation on the Courier’s proof of delivery or refuse to accept the damaged package by writing the reason in pen on the proof of delivery that the Courier requires you to sign as a delivery receipt.
The Buyer who has accepted the package subject to inspection and has subsequently found damage to the product must, within 2 working days of delivery, report the damage by sending a registered letter with return receipt to L’ ALVEARE di Maria Antonietta Taticchi – Via dei Priori n.70 – 06123 Perugia (Pg).
The Buyer must specify, in addition to the reason for the complaint, also the purchase order number and attach the tax documentation.
In the event that the Buyer finds damage to the product not visible from the outside or the mismatch in the number of products received, he or she must report the damage within 2 working days of delivery by sending a registered letter with return receipt to L’ALVEARE di Maria Antonietta Taticchi – Via dei Priori n.70 – 06123 Perugia (Pg).
The Buyer must specify, in addition to the reason for the complaint, also the purchase order number and attach the tax documentation.
If the Buyer does not act in the ways and within the terms indicated in the previous points 1, 2 and 3 of this article, he/she will lose the rights to replacement or refund.
Art. 6 – Right of withdrawal
The purchaser has the right to withdraw from this contract, without any penalty and without the obligation to state reasons, within 14 working days of receipt of the goods, in accordance with correctness and good faith. The right of withdrawal can only be exercised by final consumers who purchase without a VAT number and for whom the use of the goods does not fall within their professional activity.
The right of withdrawal must be exercised by the Buyer by sending a written communication to L’ALVEARE di Maria Antonietta Taticchi – Via dei Priori n.70 – 06123 Perugia (Pg), by registered letter with acknowledgment of receipt. The communication must include the purchase order number, the intention to withdraw from the purchase and the product or products for which you intend to exercise the right of withdrawal; the Buyer must also attach a copy of an identity document, a copy of the tax purchase documentation, indicate both a telephone number at which he can be contacted and the bank details of the current account in which he wishes to receive a refund of the amount paid.
The communication can be sent within the deadline referred to in the previous art. 6.1. by e-mail, provided that it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours.
Once the notice of withdrawal has been received by registered letter with acknowledgment of receipt, L’alveare will communicate by telephone to the Buyer the address to which the products to be returned will be shipped and the authorization to return the products themselves. The Buyer must send the product carefully packaged in its original packaging, complete with everything originally contained, to the address communicated. The shipment by the Buyer must take place via courier within ten working days of communication from L’alveare. The shipment, until received by L’Alveare, will be under the responsibility and risk of the Buyer. Upon receipt of the products, L’Alveare will verify their integrity and refund the Buyer the amount of the product purchased.
The costs incurred by the Buyer for returning L’Alveare products in the event of exercising the right of withdrawal are borne by the Buyer himself.
The integrity of the goods (products) to be returned is an essential condition for exercising the right of withdrawal.
In the event that the right of withdrawal is exercised by the Buyer in accordance with the provisions of this article, L’Alveare will refund the sums paid by the Buyer, excluding the costs of returning the products, within 30 days from the date of receipt of the communication of the withdrawal itself.
According to Legislative Decree 185/99, the right of withdrawal cannot be exercised for contracts for the supply of Personalized Products, i.e. goods made to measure or clearly personalized.
Art. 7 – Prices
For the products purchased, the Buyer will pay L’Alveare the price indicated in the online catalog at the time the Buyer placed the order. This price is expressed in Euros and includes VAT.
The shipping costs of the products are borne by the Buyer and are specified in the cart during the purchase procedure.
Product prices and shipping costs may be updated and may therefore change daily.
Art. 8 – Responsability
In the event of failure to deliver the products by L’Alveare within the deadline indicated in the previous Art. 4, the Buyer has the right to withdraw from the contract by communicating this intention by sending a registered letter with return receipt to L’Alveare di Maria Antonietta Taticchi, via dei Priori civ. 70 indicating the purchase order number, the tax documentation and the bank details for the full refund of the sums paid.
L’Alveare assumes no responsibility for disservices attributable to force majeure of any nature or kind in the event that it is unable to execute the contract within the agreed times.
Causes of force majeure include, by way of example and without limitation, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, pandemics and other similar events, as well as measures by the Public Authority, the strike of the carriers of which L’Alveare avails itself of, as well as any other circumstances that are beyond the latter’s control.
Art. 9 – Payment and invoicing methods
Secure Purchase: for the L’Alveare online shop we use the card payment system provided by Paypal. All the Buyer’s credit card data will be sent through a secure server that uses a system with the best security standards to manage sensitive information online. L’Alveare will never have access to the customer’s credit card data and will be able to manage only that information (name, surname, address) necessary for invoicing and shipping the product to the delivery address. The Buyer will pay in advance for the products ordered. Payment will include shipping costs if clearly expressed during the purchase procedure in the shop on the website www.materiaceramica.com. The Buyer’s order is considered confirmed only after payment has been made.
L’Alveare will send the invoice when shipping the Buyer’s order.
For the issuing of the tax document, the information provided by the Buyer at the time of the order will prevail. No changes will be possible after the issuance of the tax document. To this end, the Buyer carefully checks the data entered at the time of the order as these will be used for accounting records.
Art. 10 – Termination of the contract and express termination clause
The obligations assumed by the Buyer in art. 2 above (Buyer’s Obligations), as well as the guarantee of the successful completion of the payment that the Buyer must make, are essential in nature, so that, by express agreement, the Buyer’s failure to fulfill only one of these obligations will determine the legal termination of the contract pursuant to art. 1456 of the Civil Code, without the need for a judicial ruling, without prejudice to the right of L’ALVEARE di Maria Antonietta Taticchi to take legal action for compensation for further damage.
Art. 11 – Modifications
L’ALVEARE Maria Antonietta Taticchi reserves the right to vary these General Conditions at any time by publishing the current version once updated on the website www.materiaceramica.com.
Any new clauses will be effective for purchases made after the modification.
Art. 12 – Disputes and aplicable law
This contract is regulated by the Italian law. These general conditions refer, although not expressly provided therein, to Legislative Decree 206/05. 206/05.
In the event of disputes relating to the purchase contract of the products or in any case in relation to the purchase procedure on the materiaceramica.com website or in relation to these Conditions of Sale, the Buyer will always have the right to appeal to the Court of their place of residence or domicile.
The buyer may resort to extrajudicial dispute resolution procedures, referred to in articles 141 to 141-decies of the Consumer Code. The European Commission’s Online Dispute Resolution platform is available at http://ec.europa.eu/odr.
